Do I need a solicitor for my will?

No. In fact, a solicitor doesn’t need to have any involvement at all in your will to make it legally valid. You should always get advice, unless your will is straightforward. You need to get your will formally witnessed and signed to make it legally valid. You should also be aware that if a beneficiary of the Will (or their spouse or civil partner) witnesses the Will then the gift to that beneficiary will fail. We will talk you through the process and be there to make sure your will is legal. Should we believe that you need solicitor involment, we will advise this at initial consultation.

What if I don't have a LPA Document?

If you become unable to make decisions for yourself and you do not have an LPA, then the only way someone can take control of your property and financial affairs, or health and welfare, will be to go through the Court of Protection. Not only is this expensive, it could make it difficult for your wishes to be carried out, should you lose the capacity to express them for yourself.

What is a Trust?

A trust is a way of managing assets. Assets are held for a beneficiary on behalf of a trustee. The trustee or beneficiary can be one or more individuals or a company and the trustee and beneficiary can be the same person or company.

What is an advance decision (living wills)?

Under the Mental Capacity Act 2005, an advance decision is a legal statement that lets you say if you don't want certain types of medical treatment in certain situations. Eg/ you may not want to be resuscitated if you become too ill to make the decision later on, or may refuse to receive a blood transfusion.
